Terms of Service

These Terms of Service ("Terms") govern your use of the Uplift Focus application and related services ("Services").

1. Acceptance of Terms

By downloading, accessing, or using Uplift Focus, and where presented by explicitly accepting these Terms through the app's legal acceptance flow, you agree to be bound by these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.

2. The Service

Uplift Focus provides visual routine management, timer, and daily planning support tools designed for calmer structure and clarity for families and individuals.

3. Parent and Guardian Responsibility

Uplift Focus is designed for family use. Adults may manage their own Uplift Focus account. When the service is used for a minor, a parent, legal guardian, or other adult who is authorized to act on behalf of the minor is responsible for managing the account and deciding what information about the child is entered. Where parental consent is required, new or continued Cloud Sync for data relating to minors is permitted only after the required parental-consent step has been completed.

4. Not Medical Advice

Uplift Focus is a routine and planning support tool. It is not a medical device, does not provide medical or clinical advice, and is not designed to diagnose, treat, cure, or prevent any physical, psychological, or neurological condition. Any breathing exercises, timers, or sensory routines offered in the app are supportive lifestyle tools only.

5. Accounts and Security

If you create an account, you must provide accurate information and keep your credentials secure. A verified email address may be required to access and maintain Cloud Sync functionality. An account may be used across supported family devices subject to reasonable product limits.

6. Free and Premium Features

Uplift Focus offers both free features and optional paid Premium features (or trial access). Premium features may include Cloud Sync, multi-device access, and additional customization options. Current feature tiers and entitlements are described within the app and in app store listings.

7. Subscriptions and Google Play Billing

All paid subscriptions and purchases are processed directly through Google Play:

• Pricing and terms: The exact price, currency, billing cycle, and any free trial terms are displayed clearly by Google Play prior to purchase confirmation.
• Automatic renewal: Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date through your Google Play account settings.
• Managing and canceling: You can manage or cancel your subscription at any time directly in Google Play (Subscriptions section). Cancellation takes effect at the end of the current billing cycle.
• Consumer rights and refunds: Mandatory statutory consumer rights under applicable local laws apply. Refund requests are handled according to Google Play refund policies and applicable statutory rules.

8. Cloud Sync and Backups

Cloud Sync is provided as an operational synchronization service between your supported devices, not as a guaranteed archival backup service. Users remain responsible for maintaining independent copies of important information. While we strive for high service availability, occasional temporary disruptions, maintenance periods, or offline states may occur.

9. Device Unlink

The app provides a "Device Unlink" function. Using Device Unlink disconnects and cleans synced data from the specific device you are using. Device Unlink does not cancel your subscription and does not delete your cloud account or cloud data.

10. Account Deletion

You may delete your account and associated cloud data at any time by opening the Account screen in the app and choosing 'Delete account', or externally by submitting a request through our web page at /delete-account/. As detailed in our Privacy Policy, account deletion removes your cloud account and synced cloud storage, while allowing local standalone data to remain on your device so you can continue using the app locally if you wish.

11. Acceptable Use

You agree to use Uplift Focus in a lawful and respectful manner. You agree not to:

• Attempt unauthorized access to our backend systems, accounts, or networks;
• Interfere with, disrupt, or compromise system performance, security, or integrity;
• Reverse engineer, decompile, or copy the application code, except where strictly permitted by mandatory law;
• Use the app for abusive, fraudulent, or unlawful purposes.

12. Intellectual Property

All rights, title, and interest in and to the Uplift Focus application, software, logos, trademarks, and visual designs remain the property of Uplift Focus. You retain full ownership of any personal content, names, or photographs you choose to upload or create within your family profiles.

13. Service Availability and Changes

We may update, modify, or maintain features to enhance performance, ensure security, or adapt to technological developments. If we make material changes to these Terms, we will post the updated terms on this page and may request your acceptance within the app.

14. Termination

You may stop using the app and terminate your account at any time. We may suspend or terminate your access to cloud services if you materially breach these Terms or if required to do so by applicable law, subject to applicable statutory requirements.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Uplift Focus shall not be liable for indirect, incidental, or consequential damages resulting from the use or inability to use the Services, or from events beyond our reasonable control. Nothing in these Terms limits or excludes liability for intent, gross negligence, or any statutory consumer rights that cannot be disclaimed or limited under mandatory applicable law.

16. Governing Law

These Terms shall be governed by the laws of the Netherlands. If you are an individual consumer residing within the European Union, mandatory statutory consumer protection laws of your country of residence will also apply.
